2. AI Companions — Not Real People
All companions, characters, voices, images, videos, and chat responses on Velvet Echo are artificial intelligence (AI) creations. They are not real human beings. You acknowledge that:
- You are interacting with software, not a live person;
- Companions do not have independent consciousness, feelings, or legal personhood;
- Any portrayal of personality, intimacy, or emotion is simulated for entertainment.
3. Eligibility & Accounts
You may use the Services only if you can form a binding contract with us and only in compliance with these Terms and all applicable laws. You are responsible for maintaining the confidentiality of login credentials and for all activity under your account.
4. Adult Entertainment Nature
Velvet Echo provides adult-oriented fictional AI companionship and related media intended for private entertainment by consenting adults. Content may include romantic, sensual, or sexually suggestive themes involving fictional adult AI characters only.
5. License to Use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for lawful personal entertainment. You may not copy, scrape, reverse engineer, resell, or commercially exploit the Services except as expressly allowed by us in writing.
6. Purchases, Credits & Subscriptions
Paid features (including session unlocks, credits, or subscriptions) are subject to our Refund & Billing Policy and the terms of our payment processor (including CCBill where applicable). Prices and offerings may change.
7. Prohibited Conduct
You agree not to use the Services to request, create, upload, share, or pursue any of the following:
- Any content involving minors (anyone 17 or under), including fictional, roleplay, animated, AI-generated, or “aged-up” depictions — strictly prohibited;
- Real-person deepfakes, impersonation, or non-consensual intimate imagery of actual individuals;
- Content that exploits, abuses, or endangers any person;
- Illegal activity of any kind, including trafficking, exploitation, or solicitation of illegal services;
- Harassment, threats, stalking, or doxxing;
- Malware, scraping at scale, account fraud, payment fraud, or chargeback abuse;
- Attempts to bypass age gates, paywalls, or security controls;
- Content that promotes terrorism, extreme violence for its own sake, or other unlawful material.
We may suspend or terminate access immediately for violations, with or without notice, and may report illegal activity to authorities where required.
8. Acceptable Use
Your use must also comply with our Acceptable Use Policy, which forms part of these Terms.
9. AI Limitations & No Professional Advice
AI responses can be inaccurate, incomplete, or inappropriate. The Services are not medical, mental-health, legal, or financial advice and are not a substitute for professional care. See our AI Disclosure & Safety Notice.
10. Intellectual Property
Velvet Echo branding, companion personas, site design, software, and generated media (except where third-party rights apply) are owned by us or our licensors. Feedback you submit may be used by us without obligation to you.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELVET ECHO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnity
You agree to indemnify and hold harmless Velvet Echo and its officers, members, and agents from claims arising out of your misuse of the Services or violation of these Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Except where prohibited, disputes shall be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there. If a court finds any provision unenforceable, the remaining provisions continue in effect.
15. Changes
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms. Material changes may be highlighted on this Legal Center.
